Nebraska DUI Defense

This Is No Place To Practice.

The courtroom can be a scary place to find yourself. Our complex and confusing justice system leaves most people feeling overwhelmed and confused. Worse yet, some lawyers want to learn courtroom skills on your case. DUI trials and appeals should never be "on the job" training. Arm yourself with an effective and experienced  lawyer who will navigate the system and defend you ethically and skillfully.
Legal Insight - Courtroom Instinct
Baxley Law Office is a trial and appellate litigation boutique law firm focused on defending DUIs. Founding attorney Stephen (Steve) Baxley is well known for finding creative solutions in complex cases and teaching criminal justice courses at the University of Nebraska at Omaha. He uses his extensive litigation experience to fight for DUI defendants in all Nebraska state courts.

Much of Steve's reputation is built on his ability to communicate with juries to help them see the truth and reach a fair verdict. Steve has experience in all aspects of criminal litigation from case intake through trial and in appeals up to and including the United States Supreme Court. He has taken over 100 jury trials to a verdict and continuously participates in world-class advocacy training. Steve often serves as a teacher, author, advisor, mentor, and television commentator on litigation and trial advocacy issues. Due to this, and his vast experience in both prosecuting and defending DUI cases, other attorneys frequently come to him for help sharpening their trial strategy in particularly difficult cases.

Steve also believes in taking the ethical approach. Judges and juries have a particular ability to see through unethical behavior and often turn against those whom they perceive to be untrustworthy. Steve's Christian faith, with its moral and ethical teachings, guides the decisions he makes personally and professionally; and he has found that both he and his clients benefit from his ethical approach.

Steve founded Baxley Law Office in 2002 originally in Houston, Texas. He moved to Nebraska and moved the practice to Omaha in 2007. He has represented criminal defendants in almost every type of intoxication-related offenses.

Prior to founding his own firm, Steve spent three years as an Assistant District Attorney in the Harris County District Attorney's Office, where he prosecuted felony, misdemeanor, and juvenile cases. As an Assistant District Attorney, Steve prosecuted thousands of cases with the Drunk Driving Task Force, some of the most highly trained police officers in the country. Doing so, he saw first-hand the mistakes defense lawyers make in DUI cases. But this extensive experience also taught him the state's strategies, tactics, and some not so obvious weaknesses.

Once he started defending DUI cases, Steve honed his skills by working hand-in-hand with some of the nation’s top DUI defenders. Moreover, he has spent hundreds of hours and thousands of dollars taking advanced DUI defense training at places like Harvard Law School to gain additional very technical/scientific expertise.

Before joining the D.A.'s Office, Steve spent several years as a commercial litigation and medical malpractice trial attorney. Steve is a graduate of the University of Houston Law Center and the University of Nebraska at Omaha. He also served as a U.S. Air Force All-Source Intelligence Analyst and a U.S. Army Signals Intelligence Analyst.

Steve Baxley has experience in about every kind of criminal charge on the books, ranging from underage drinking and DUI, to homicide and international drug distribution conspiracies. However, Steve is very selective in whom he agrees to represent. He believes clients are best served when he knows their story. No one is merely the facts of a DUI case.

With same day or next day appointments, flat fee billing, and daily telephone availability, Steve gives personal attention to every client he agrees to defend. He spends a great deal of time on the "little details" because he knows they are often key in building a strong defense.

Because he doesn't use a "one size fits all" approach, our legal fees are sometimes a little higher, but our courthouse success and client satisfaction rates speak for themselves.

Steve does not believe in charging DUI clients by the hour, nor does he charge a "travel fee" to go to distant Nebraska counties. If the case and client match what Steve is looking for, he will try to help. In part, because he focuses on the details of every case.
